Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and CK Film & Entertainment LLC (“CK Film & Entertainment LLC”, “we”, “us”). By creating an account or using watch.ckindiefilms.com (the “Service”), you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.

1. Eligibility

The Service is available only to users physically located in the United States and only to users at least 18 years of age (or the age of majority in their state). By using the Service you represent that you meet these requirements.

2. Account

You must provide accurate registration information and keep your password confidential. You are responsible for all activity on your account. Accounts are personal and non-transferable. Sharing credentials is a breach of these Terms. Each account is limited to two (2) concurrent streams; a third concurrent stream is denied automatically.

3. Payments and pricing

All prices are in U.S. dollars and subject to applicable sales tax, calculated at checkout. We may change prices for future transactions; such changes do not affect a transaction you have already completed. Stripe processes all payments and stores all card data; we do not store full card numbers.

4. CK+ subscription — auto-renewal disclosure

CK+ is an auto-renewing monthly subscription. By subscribing you authorize CK Film & Entertainment LLC to charge your payment method on file at the stated monthly price (plus tax) automatically every month until you cancel. New subscriptions begin with a 7-day free trial. We will charge the first monthly fee at the end of the trial unless you cancel before then. You may cancel at any time from your billing page (Account → Billing → Manage subscription) or by emailing ckfilmentertainment@gmail.com. Cancellation takes effect at the end of the current billing period; you retain access until then. Cancellation requires no fee and no explanation.

5. Refund policy

• Rentals are non-refundable once playback has begun. If you have not played a rental, you may request a refund within 24 hours of purchase.
• Purchases (TVOD ownership) are refundable within 24 hours of purchase only if you have not played the film.
• Subscription charges are not pro-rated on cancellation. Cancel before the renewal date to avoid the next charge.
• Technical issues are evaluated case-by-case. Email ckfilmentertainment@gmail.com.

6. License grant

We grant you a non-exclusive, non-transferable, revocable license to stream the films in your entitlement set for personal, non-commercial use only. You may not download, copy, redistribute, rebroadcast, sell, sublicense, or use any film in a public performance, commercial setting, or as part of any service.

7. Anti-piracy and prohibited conduct

You may not, and may not assist any third party to:

• Circumvent any digital rights management or technical protection measure;
• Remove, obscure, or alter any forensic watermark or copyright notice (visible or burned-in);
• Record, capture, screen-record, or re-stream any film delivered through the Service;
• Scrape, mirror, or systematically download content;
• Use the Service to violate any law or third-party rights;
• Share account credentials or use someone else’s credentials;
• Attempt to disrupt or compromise the Service’s security or integrity.

Each playback embeds a forensic watermark unique to your account and session. Violations may result in immediate termination, civil action for damages (including, where applicable, statutory damages of up to $150,000 per work under 17 U.S.C. § 504), and criminal referral under 17 U.S.C. § 506. 8. DMCA

If you believe content on the Service infringes your copyright, see our DMCA notice and designated agent.

9. Termination

We may suspend or terminate your account for any breach of these Terms. You may close your account at any time per Section 4 or by emailing ckfilmentertainment@gmail.com. Termination does not relieve you of obligations accrued before termination (e.g. current-period subscription fees).

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (i) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) U.S. $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES.

11. Dispute resolution

Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Fayette County, Kentucky, and the parties consent to the personal jurisdiction of those courts. The parties waive any right to a jury trial.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky and the United States, without regard to conflict-of-laws principles.

13. Changes

We may update these Terms from time to time. Material changes will be posted with a revised effective date and, where required by law, communicated by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
