Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and CK Film & Entertainment LLC (“CK Film & Entertainment LLC”, “we”, “us”). By creating an account or using watch.ckindiefilms.com (the “Service”), you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.

1. Eligibility

The Service is available only to users physically located in the United States and only to users at least 18 years of age (or the age of majority in their state). By using the Service you represent that you meet these requirements.

2. Account

You must provide accurate registration information and keep your password confidential. You are responsible for all activity on your account. Accounts are personal and non-transferable. Sharing credentials is a breach of these Terms. Each account is limited to two (2) concurrent streams; a third concurrent stream is denied automatically.

3. Payments and pricing

All prices are in U.S. dollars and subject to applicable sales tax, calculated at checkout. We may change prices for future transactions; such changes do not affect a transaction you have already completed. Stripe processes all payments and stores all card data; we do not store full card numbers.

4. What you are renting

CK+ does not sell a subscription. Every transaction is a one-time payment for a single film, and CK Film & Entertainment LLC will never charge your payment method on a recurring basis.

• Every film costs $3 to rent. One flat price across the whole catalog, charged once. There is no subscription and nothing renews.
• A rental gives you 3 days — 72 hours — counted from the moment you start watching, not from the moment you pay. Rent a film tonight and start it on Sunday and you still get the full 3 days; the clock does not begin until you press play. Within that window you can watch as many times as you like, on any device you sign in on.
• Prices shown in the catalog exclude sales tax. Tax is calculated at checkout based on your billing address, and the final total is shown to you before you confirm payment.
• A free CK+ account is required to rent, because access is tied to your account so you can watch again later and on another device.

5. Refund policy

• Rentals are refundable within 24 hours if you have not started watching — and because the 3-day clock only starts when you press play, an unwatched rental is always still refundable in that window. Once you have started the film the $3 is not refundable, but if something went wrong, write to us.

6. License grant

We grant you a non-exclusive, non-transferable, revocable license to stream the films in your entitlement set for personal, non-commercial use only. You may not download, copy, redistribute, rebroadcast, sell, sublicense, or use any film in a public performance, commercial setting, or as part of any service.

7. Anti-piracy and prohibited conduct

You may not, and may not assist any third party to:

• Circumvent any digital rights management or technical protection measure;
• Remove, obscure, or alter any forensic watermark or copyright notice (visible or burned-in);
• Record, capture, screen-record, or re-stream any film delivered through the Service;
• Scrape, mirror, or systematically download content;
• Use the Service to violate any law or third-party rights;
• Share account credentials or use someone else’s credentials;
• Attempt to disrupt or compromise the Service’s security or integrity.

Each playback embeds a forensic watermark unique to your account and session. Violations may result in immediate termination, civil action for damages (including, where applicable, statutory damages of up to $150,000 per work under 17 U.S.C. § 504), and criminal referral under 17 U.S.C. § 506. 8. DMCA

If you believe content on the Service infringes your copyright, see our DMCA notice and designated agent.

9. Termination

We may suspend or terminate your account for any breach of these Terms. You may close your account at any time by emailing ckfilmentertainment@gmail.com. Termination does not relieve you of obligations accrued before termination.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (i) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) U.S. $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES.

11. Dispute resolution

Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Fayette County, Kentucky, and the parties consent to the personal jurisdiction of those courts. The parties waive any right to a jury trial.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky and the United States, without regard to conflict-of-laws principles.

13. Changes

We may update these Terms from time to time. Material changes will be posted with a revised effective date and, where required by law, communicated by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
